1. Acceptance of Terms
By accessing and using the Safety Grade website (“the Site”) at https://safetygrade.ca, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Site.
2. User Registration and Information Storage
By registering an account on Safety Grade, you agree to provide accurate and truthful information. You may be asked to indicate your role (e.g., student, parent, staff member) when submitting ratings or stories. Your account information and any data you submit, including school ratings, survey responses, and stories, will be stored and may be reviewed for moderation, quality assurance, and compliance with these Terms & Conditions.
3. User Conduct
You agree to use the Site in accordance with all applicable laws and not to engage in any conduct that is unlawful, offensive, or harmful. This includes, but is not limited to:
- Posting content that is false, misleading, defamatory, abusive, or otherwise objectionable.
- Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Collecting or storing personal data about other users without their consent.
- Engaging in spamming, phishing, or any other unauthorized advertising.
4. User-Generated Content and Moderation
All content you submit to Safety Grade, including ratings, survey responses, and written stories about schools, is subject to moderation before publication. Content that does not comply with these Terms & Conditions, or is deemed inappropriate, may be edited, withheld, or removed at our sole discretion. You may choose to submit stories anonymously; however, certain data points (such as your indicated role) may still be visible. By submitting content, you grant Safety Grade a non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, and distribute your content as needed to operate and improve the Site.
You acknowledge that your ratings and responses may be aggregated and analyzed to produce overall school ratings in categories such as Staffing, Security, Facilities, Support, and Visibility, and that your submissions may influence a school’s overall ranking. Safety Grade may publicly display these aggregated results, including average category ratings and rankings.
5. Moderation and Removal of Content
We reserve the right, but not the obligation, to monitor, edit, or remove any User-Generated Content at our discretion. We may remove content that we believe violates these Terms & Conditions or is otherwise objectionable.
6. Intellectual Property
All content on the Safety Grade Site, including but not limited to text, graphics, logos, images, and software, is the property of Safety Grade or its content suppliers and is protected by copyright and other intellectual property laws. You may not use any of this content without our prior written permission.
7. Disclaimers and Limitation of Liability
Safety Grade provides a platform for users to share their experiences, opinions, and assessments of school safety conditions. The Site’s content, including ratings, stories, and rankings, is primarily user-generated and reflects subjective views that may not be verified for accuracy or completeness. We do not endorse or guarantee the reliability, completeness, or timeliness of any user-submitted information.
Any reliance you place on user-generated content is strictly at your own risk. Safety Grade is not liable for any loss or damage arising from the use of, or reliance on, information posted by users. We make no representations or warranties about the accuracy of aggregated ratings or the appropriateness of individual schools for any purpose.
8. Third-Party Links
The Site may contain links to third-party websites. These links are provided for your convenience only. We do not endorse, control, or assume any responsibility for the content or practices of any third-party websites.
9. Indemnification
You agree to indemnify, defend, and hold harmless Safety Grade, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Site or your violation of these Terms & Conditions.
10. Changes to the Terms & Conditions
We reserve the right to modify these Terms & Conditions at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after any changes constitutes your acceptance of the new Terms & Conditions.
11. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
